You must never open a will on your own

In recent years, end-of-life planning (shukatsu) has increasingly become a topic of public conversation, and a growing number of people consult our firm about it. More and more people also leave wills as part of their end-of-life planning.
While sorting through the belongings of a person who has passed away, you may find a will. You may feel the urge to check what it says right away, but you must never open it on your own. This is because the law requires that a will be opened as part of a court procedure called "inspection" (kenshin) (Article 1004 of the Civil Code).
This rule exists to prevent alteration, forgery, or concealment of the will by the heirs. Opening a will anywhere other than the family court is, in principle, unlawful, so please take care.
(Inspection of a Will)
Article 1004 The custodian of a will must, without delay after acquiring knowledge of the commencement of succession, submit it to the family court and request its inspection. The same applies when there is no custodian of a will and an heir has found the will after that.
2 The provisions of the preceding paragraph do not apply to a will made by notarized deed.
3 A sealed will may not be opened at the family court unless the heirs or their agents are present.
If you open a will outside the court without undergoing "inspection," you are subject to a civil fine of up to 50,000 yen (Article 1005 of the Civil Code).
Opening the will on your own does not immediately invalidate its contents; however, other heirs may suspect you of having forged the will, which could make the inheritance dispute far more complicated and prolonged. For this reason, you must follow the rules set by law.
Even if you have already opened the will, promptly consulting the family court and filing the petition may allow you to avoid serious disadvantages. Do not assume it is "too late" — consult a lawyer as soon as possible.
The remainder of this article explains the inspection procedure for wills in detail.
About the Inspection Procedure
As described above, the inspection of a will is the procedure of opening the will at the family court.
The court notifies each heir that the will exists and of the date, time, and place of its opening, and then the will is opened with the heirs and other parties concerned assembled.
The inspection procedure is intended to check whether the formal aspects of the will are in order and whether it properly satisfies the requirements of a will. In other words, the court checks such matters as whether the document is properly drawn up and whether the date and signature are properly provided; it is not a procedure for deciding or contesting the validity of the will, much less a procedure for the heirs to dispute the contents of the will among themselves.
Inspection is required for a holograph will (a will written by the testator's own hand) and a secret will, but not for a notarized will. A notarized will is prepared and stored in a strictly controlled manner by a notary, so there is no risk of forgery or the like.
Note that even for a holograph will, inspection is not required if you use the system of depositing the will with the Legal Affairs Bureau (the Holograph Will Custody System). If you would like to know more about this system, please see the article "I want to know about the application for custody of a holograph will."
Recently, this custody system of the Legal Affairs Bureau has been spreading, and it offers major advantages such as:
- No inspection required
- Prevention of loss and alteration
and these are significant benefits.
An increasing number of people consider using this system from the stage of preparing a will during their lifetime.
Flow of the Inspection Procedure
①File a petition for inspection with the family court
You must submit a petition for inspection of a will to the family court, attaching the required documents.
The required documents include certified copies of the family register of the testator covering the period from birth to death, and certified copies of the family registers of all the heirs. Collecting these registers takes both time and effort, but if you retain a lawyer, the lawyer will assist in collecting them as well.
The court to which you file the petition is the family court with jurisdiction over the testator's "last domicile." For example, if the testator's address at the time of death was in Fujieda City, you would file with the Shimada Branch of the Shizuoka Family Court. Note that even if all of the heirs live outside Shizuoka Prefecture, the petition must be filed with the family court in Shimada City, so care is needed.
In addition, the inspection petition may be filed by the "custodian" or the "finder" of the will. It is not necessary for all of the heirs to be petitioners.
②The court designates the date and time of the inspection
After the petition is filed, the family court designates the date and time on which the inspection procedure will actually take place. This varies from case to case, but it is usually set about one month after the petition. You will want to check the contents of the will right away, but you must wait until the day of the inspection. Until that day, do not open the will, and keep it carefully so as not to lose it.
③On the day of the inspection
On the designated date and time, you go to the family court bringing the will with you. It is not obligatory for all of the heirs to appear, and the inspection is carried out even if some are absent. In some cases, a lawyer attends as a representative.
In the inspection procedure, a judge and a court clerk attend, and the seal of the will is opened. The judge asks the custodian of the will and the heirs questions, such as where the will had been kept and whether the handwriting of the will is that of the testator.
When this is finished, the court attaches a certificate of inspection to the will and returns it, and the inspection procedure is concluded.
④After the inspection procedure is completed
After the inspection procedure is completed, the inheritance procedures are carried forward in accordance with the contents of the will. Depending on the case, the heirs may have to discuss the matter among themselves.
Note that even while the inspection petition is pending or you are waiting for the date on which the inspection will actually take place at the court, the period for filing a petition for renunciation of succession and other deadlines do not change, so care is needed. If you find a will, each inheritance procedure must be started promptly.
To repeat, the deadline for renunciation of succession does not stop simply because there is a will. If there is any possibility of debts, it is essential to consider renunciation of succession in parallel with the inspection.
Summary
The above is the explanation of the inspection procedure.
When a will is found, many people are at a loss as to how to deal with it. If you open it on impulse, various disadvantages may arise, so first of all, do not open it and have the court carry out the inspection procedure.
The subsequent inheritance procedures can change greatly depending on the contents of the will after it is opened. Involving an expert at an early stage reliably prevents unnecessary disputes.
Consulting a lawyer may resolve your concerns, so please feel free to make use of the legal consultation service of the Yaizu Sogo Law Office.
Frequently Asked Questions
I am currently in mediation for the division of the estate, and a will has been found. What should I do?
File a petition for inspection immediately. Depending on the contents of the will, it may become unnecessary to continue the mediation.
I have already opened the will. Is that unlawful?
Formally, you may be subject to a civil fine, but in many cases serious disadvantages can be avoided if you promptly file a petition for inspection with the family court. Please consult us right away.
Is inspection required even for a notarized will?
No. Only holograph wills and secret wills are subject to inspection.
A will was found during the mediation for the division of the estate. What will happen?
Depending on its contents, the mediation may be terminated or have to be started over. The petition for inspection must be filed immediately.
Some of the heirs are elderly and cannot attend the inspection. Is that all right?
The inspection is carried out even if not all of the heirs appear. It is not obligatory, so there is no problem.
However, the petitioner for the inspection must always attend. If the custodian of the will has circumstances that prevent appearance, another heir should become the petitioner, or it would be advisable to entrust the matter to a lawyer.
How much does the inspection cost and how long does it take?
The actual costs are around several thousand yen, and it generally takes about one month from the petition to the inspection.
What should I bring on the day of the inspection?
If you are keeping the will, be sure to bring the original will with you.
May the heirs make an arrangement among themselves without following the contents of the will?
If all of the heirs agree, it is also possible to proceed with a division different from the contents of the will.
I am worried whether the will is genuine. What should I do?
The formalities are checked in the inspection procedure, but if forgery or invalidity is suspected, the matter will be contested in a separate lawsuit.
